We do not use your mobile number or text message content to build advertising profiles, and we do not use them for interest-based or cross-context behavioral advertising. If you opt in to marketing texts, we may use the programs and events you have participated in to invite you to future events offered by the same program.
3. Text Messaging Programs
3.1 What we send
We operate three categories of text messaging programs:
- Verification Codes. Short, automated messages containing a one-time passcode you requested in order to sign in, verify your identity, reset a credential, or authorize a sensitive action. These messages are sent only in response to an action you take.
- Service Texts (two-way). Notifications, reminders, and conversational messages related to a program, service, event, or inquiry you are involved in, and replies from our staff to messages you send us.
- Marketing Texts. Occasional automated messages inviting you to future Public Strategies events and programs you have not yet signed up for. Sent only to individuals who confirm they are 18 or older and have given separate prior express written consent.
Verification codes and service texts never contain marketing content. Marketing texts are sent only with the separate consent described in Section 3.2.
3.2 How you opt in
You may opt in by checking an unchecked consent box on one of our web or paper forms, by providing your number to program staff and agreeing to be texted, by texting a start keyword to one of our numbers, or by initiating a conversation with us by text. You receive a verification code only when you request one by entering your mobile number on a sign-in or account screen. Consent to receive text messages is never a condition of receiving any product, service, or program benefit from Public Strategies.
To receive marketing texts, you must check a separate, unchecked box (or sign a paper form) that specifically authorizes marketing text messages and confirms you are 18 or older. Texting us first, texting a keyword, or giving consent verbally to staff does not enroll you in marketing texts.
3.3 How you opt out
You may stop text messages at any time by replying STOP to any message from us. We also honor QUIT, END, CANCEL, UNSUBSCRIBE, REVOKE, and OPT OUT, as well as any other reasonable method that clearly expresses your wish to stop receiving messages, including telling program staff, emailing privacy@publicstrategies.com, or calling 405-848-2171. We will send you a single confirmation message and then stop. We process opt-out requests promptly and in no event later than ten (10) business days after receipt.
Marketing texts are sent from a separate number. If you reply STOP to a marketing text, we will stop sending you marketing texts and, where required by law, other text messages from us; we may send one message asking which messages you want to stop. To stop all text messages from Public Strategies, reply STOP to a service text, tell program staff, or email privacy@publicstrategies.com.
Opting out of text messages does not remove you from a program or stop other forms of contact, such as email or phone, unless you ask us to stop those as well.
3.4 Message frequency and rates
Message frequency varies. Message and data rates may apply. Your mobile carrier’s charges are your responsibility.
3.5 Full terms
The complete terms of our text messaging programs, including supported carriers, HELP instructions, and carrier disclaimers, are in our Terms of Service.
4. Tools and Technologies We Use
We may use the following technologies and third-party platforms:
- Google Analytics – website traffic and user behavior measurement
- Google Ads / Display Network – advertising and retargeting
- Meta Pixel (Facebook/Instagram) – ad interaction tracking and social campaign optimization
- Basis Technologies – programmatic and contextual ad targeting
- Messaging Platforms (including our internal platform, ergo) – delivery and receipt of text messages and one-time passcodes
- Wireless Carriers and Messaging Aggregators – transmission of messages to your device
- Other Advertising, Analytics, and IT Service Providers – as needed for delivery and measurement
Advertising and analytics providers may collect information independently and combine it with other data they hold. These advertising and analytics tools are not used with, and do not receive, mobile opt-in data, mobile numbers collected for messaging, or text message content.
5. Cookies and Tracking Technologies
We use cookies and similar technologies (web beacons, pixels, analytics tags) to remember your preferences, analyze performance, and deliver tailored advertising. You may disable cookies through your browser settings. Where required, we display a cookie consent banner with options to accept, decline, or customize. We honor Global Privacy Control (GPC) signals as a request to opt out of the sale or sharing of personal information for cross-context behavioral advertising.
6. Data Sharing and Disclosure
We do not sell your personal information for money. Our use of advertising cookies and pixels may be considered “sharing” for cross-context behavioral advertising under certain state privacy laws; see Section 9 for how to opt out.
6.1 Mobile and text messaging data — no sharing for marketing
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the categories of sharing described elsewhere in this Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
We share your mobile number and message content only with the service providers that are strictly necessary to deliver the messages you asked for — such as messaging platform providers, messaging aggregators, and wireless carriers — and only for that purpose. These providers are restricted by law and carrier obligations from using this information for their own purposes.
Where we operate a messaging program on behalf of a client (for example, a state agency or a federally funded program), your mobile number and message content may be shared with that client as the program sponsor, for program administration only, and subject to that client’s own privacy obligations. The program will identify its sponsor when you enroll.
6.2 Other sharing
We may otherwise disclose information:
- To service providers who assist in our operations, under written confidentiality and data protection terms
- To our clients and grant funders, for program administration and reporting, in the form required by our contracts
- To comply with legal obligations, lawful requests, subpoenas, or court orders
- To protect the rights, property, or safety of Public Strategies, our staff, program participants, or others, including to investigate fraud or a credible threat of harm
- In connection with a merger, acquisition, financing, or sale of assets, in which case we will require the recipient to honor this Policy or provide notice and choice as required by law
- With your direction or consent
7. Data Retention
We keep personal information only as long as needed for the purposes described above, then delete or de-identify it. Specifically:
- Text message consent and opt-out records: retained for at least five (5) years after the relationship ends, so that we can demonstrate when and how you consented and that any opt-out request was honored.
- Message content from two-way conversations: retained for five (5) years or the period required by the applicable program contract or grant, whichever is longer.
- One-time passcodes: the code itself is short-lived and expires within ten (10) minutes; we retain only the metadata of the verification event for security and fraud-prevention purposes.
- Website analytics and advertising data: retained per the retention settings of the applicable platform.
- Program records: retained per the record retention requirements of the applicable federal, state, or tribal contract.
8. Data Security
We implement appropriate technical and organizational measures to protect your information from unauthorized access, alteration, or disclosure, including access controls, encryption in transit, and vendor security review. One-time passcodes are single-use, time-limited, and stored in hashed form.
We will never ask you to send us a one-time passcode by text, email, phone, or chat. If someone asks you for your code, it is likely a scam. Do not share it, and please report it to us at privacy@publicstrategies.com.
Text messaging is not a secure channel. Please do not send us Social Security numbers, financial account numbers, health information, or other sensitive details by text.
No internet-based service is completely secure, and we cannot guarantee absolute protection. If a breach affecting your personal information occurs, we will notify you and applicable regulators as required by law.
9. Your Choices and Rights
9.1 Everyone
- Text messages: reply STOP to any message or contact us using the details in Section 12.
- Email: use the unsubscribe link in any marketing email.
- Advertising cookies: Google Ad Settings · Facebook Ad Preferences · Basis Technologies opt-out · Google Analytics Opt-out Browser Add-on · industry tools at optout.aboutads.info and optout.networkadvertising.org
- Browser controls: configure your browser to reject cookies or notify you when cookies are used.
9.2 State privacy rights
Depending on where you live, you may have the right to: know what personal information we hold about you; access or obtain a copy of it; correct inaccuracies; delete it; opt out of targeted advertising, the sale or sharing of personal information, and certain profiling; and not be discriminated against for exercising these rights. Some states also allow you to appeal a denial of your request.
To exercise a right, contact us at privacy@publicstrategies.com or 405-848-2171. We will verify your identity before responding and will respond within the time period required by your state’s law. An authorized agent may submit a request on your behalf with written authorization.
10. Children’s Privacy
Our website is not directed to children under 13, and our text messaging programs are intended for individuals 18 and older unless a specific program states otherwise and obtains appropriate parental or guardian consent. We do not knowingly collect personal information from children under 13 online, and we do not knowingly send text messages to a number we know belongs to a child unless that program has obtained such consent. If we learn we have collected such information, we will delete it promptly. Where a program we operate serves minors, that program collects information, including consent to send text messages, under the terms of its own notice and with the consent of a parent or guardian, in addition to any requirements of the sponsoring agency.
Marketing texts are sent only to individuals who confirm they are 18 or older, regardless of program.
11. Updates to This Policy
We may update this Privacy Policy periodically. We will post changes on this page with a new effective date. If we make a material change affecting how we use your mobile number or message content, we will provide notice before the change takes effect. We encourage you to review this Policy regularly.
